Probate applications moving online

We live in a world where gradually everything is moving online and the Probate Registry has now decided the time for them is now!

On 30th September the government has responded to a recent consultation and confirmed that probate applications for professional users should be made online from 2nd November 2020. However there is a grace period whereby paper applications can still be sent in, before 30th November to allow further time for firms get ready.

The online probate service for professional users can be used for:-

  1. Probate (all types of executors)
  2. Intestacy (on behalf of a lawful spouse/civil partner or single child)
  3. Admon Will (residuary legatees and devisees in trust)
  4. Foreign domicile (if the application is for immoveable property).

There are still some exceptions which currently include:-

  • Continued paper based application for Grants of Letters of Administration (Intestacy) to be made by post or the online process
  • Defined specialist applications can still be made by post

There is no doubt that this will be a useful tool for the future, however the system isn’t entirely ‘online’ as  the original Will (and Codicil, if relevant) does still need to be sent in to the Probate Registry.  The Probate Registry has stated this process will mean Grants are issued quicker when applied for online, rather than by post.
